TRAI's regulation for maximum 100sms/day. What do you think?

TRAI (Telecom Regulatory Authority of India) has capped the total outgoing SMS text messages to 100/day per customer. This move has been widely praised as a measure to stop those sneaky telemarketers who troubled you via unwanted text messages all thoughout the day. There has been quite some protests against it too.
All sms services are now categorized into either of the two categories: promotional, non-promotional.
Also the free, web-based, bulk sms sites are required to disable sms between 9pm-9am.

My opinion is somewhat different:
1- If TRAI can categorize and act on bulk-sms providers, why to limit outgoing sms on individuals? Most crap promo-sms are sent via those bulk sms'ing platforms and NOT via personal connections.
2- If personal numbers are being used for promo-SMS, there should be a way to report it to TRAI and it should be redirected to the respective service-provider. The service provider already has a record of it and can ban that number.
